Probate and Estate Administration
When a loved one passes away, their estate must be managed and settled through a legal process known as estate administration.
We guide executors, administrators, and families through each step so the estate is handled properly and in accordance with the law
and the decedent’s wishes.
Probate and Administration
- Probate (With a Will): The Executor files a petition with the Surrogate's Court to admit the Will. Once approved, the Court issues Letters Testamentary that authorize the Executor to manage the estate.
- Administration (Without a Will): A qualified family member petitions for appointment. Once approved, they receive Letters of Administration that authorize them to collect assets, pay expenses, and distribute property under New York law.
Both processes require gathering assets, addressing debts and taxes, and distributing what remains to rightful beneficiaries or heirs.
Our Process: From Start to Finish
- Initial Engagement
- Court Appointment
- Inventory and Marshaling Assets
- Managing Debts, Expenses, and Taxes
- Ongoing Guidance and Communication
- Distributions to Beneficiaries
- Closing the Estate
From our initial meeting through final distribution, we guide you through each phase of estate administration. We handle court filings, help you marshal assets, manage creditor claims and tax obligations, and ensure proper distributions, all while keeping you informed and confident in your role as Executor or Administrator.
